What You Should Know About Whistleblower Act

By Ava Hudson

The many injustices in various systems are quite an ugly truth. There are those trying to correct them and to accomplish that, people need to work for them. You can take action despite the fear of retaliation. The whistleblower act really is something that benefits those seeking justice in a system that has chosen to become flawed.

Whistleblower protection act provides statutory protections for a federal employee when he makes a disclosure which would evidence improper or illegal government activities. This applies to most employees of the federal executive branch. When there would be action done for the protected disclosure by one covered employee, WPA would be in effect.

Congress enacted in 1989 the WPA having the intent of protecting and strengthening the rights that federal employees have so wrongdoings may be eliminated within the government. That is achieved by a mandate for personnel to not suffer some adverse consequence from a prohibited practice. This also ensures the protection of those who are in disciplinary actions from that prohibited practice.

There are some considerations to be observe for a WPA to be triggered. Personnel action would need to be taken due to a protected disclosure which was made by the covered employee. A covered employee is either an applicant, current or former employee for an executive branch of the government. Exclusions are also observed like those in positions which has a policy making, confidential, policy determining or policy advocating character. Exclusions from protection of WPA may also be determined by the president.

Information given by covered employees which he believes would evidence some violation to laws, regulations or rules and also abuse of authority, gross mismanagement, danger to pubic safety and health and waste of funds are considered protected disclosures. Employees are protected from retaliation through WPA. Personnel action includes a wide range in action having negative and adverse impact to an employee, .

There have been enhancements made on WPA recently. This tightens non disclosure agreement requirements, it also clarifies the scope of which protected disclosures are and also expands what penalties would be given when there is a violation to WPA. Ombudsmen are also established for certain agencies to facilitate observance of WPA.

The act can encourage many whistleblowers for them to come forward. There will be no fear that there would be retaliations from the disclosures that they make because there are protections set for them, especially given the enhancements made which makes for stringent guidelines. It would be easy to expose wrong practices.

Acts similar to it can lead for better systems within a government. People could rally for the truth and not be punished for it. That would encourage a society to be one who conducts its business in a righteous manner. Citizens may effectively police their government.

This whistleblower act will be among many that would empower people. This enables people to hold those in the wrong accountable for what they have done. There would be fairness in a community and those who do right would not fear to correct what is wrong.
